Terms of Service

These terms are an agreement between you and Darren.G ("we"), who run GERMINALS. By playing, you agree to them. If you don't agree, please don't play. Our Privacy Policy explains how we handle your data.

Who can play

You must be at least 13, or the higher minimum age for online services in your country. If you are under the age of adulthood where you live, a parent or guardian should review these terms with you.

Your account

The game creates a guest account the first time you play a public match or open the shop. Guest progress is tied to your browser and is lost if you clear its data, or if the account stays inactive for 90 days. You can sign in with Google to keep your progress across devices. You are responsible for activity on your account.

Fair play

You agree not to:

cheat, use bots or automated play, or exploit bugs
interfere with the game, its servers or other players' connections, or try to get around its limits
use a germ name or private room chat that is hateful, harassing, sexual, threatening or illegal, or that impersonates someone
use another person's account without permission
click or view ads automatically or dishonestly, or try to inflate ad activity

We may change names, remove scores or items, or suspend or close accounts that break these rules. We may do this without notice where needed to protect the game or its players.

Matches and bots

Public matches fill empty spots with computer-controlled germs, and a bot votes for your germ if you lose your connection or leave. Your result depends on how the crowd votes, so we can't promise any particular outcome. Results decided by the server are final, including after technical problems, although we may correct scores we find to be wrong.

Cosmetic items and purchases

Most cosmetic items are free. Some items, sets and ad removal are paid, and our Payment Terms apply to those. All sales are final, and purchases are not refunded if the game changes or ends, to the fullest extent the law allows. You receive a personal, revocable right to use items in the game, and do not own them as property. Items have no cash value, and cannot be sold, traded or exchanged for money.

We show ads from third parties, delivered by our ad partner. We ask for non-adult ads only, but we don't create or check each ad, and filters can miss things. Ads are not our endorsement. Anything you do with an advertiser, including buying from them, is between you and that advertiser, under their terms, and we are not responsible for it. If you see an ad that seems inappropriate, please email playgerminals@gmail.com. Our Privacy Policy explains what data ads use and your choices.

Not advice

GERMINALS is for entertainment. Its questions and facts, including those about health and germs, may contain errors and are not medical or professional advice. Speak to a qualified professional about your health. Don't take questions in the game as encouragement to do anything unsafe.

Private rooms

In private rooms, the host's browser runs the match, and we do not monitor or moderate chat in those rooms. You are responsible for what you say, and for who you invite. Scores from private rooms don't count toward the leaderboard.

Our game

The game, including its art, music, code and question bank, belongs to Darren.G or its licensors. You may play it for personal use, and share screenshots and clips of your play. You may not copy, resell or redistribute the game without permission.

Availability

We may change, pause or end all or part of the game at any time, and we don't promise it will always be available or free of errors. Progress may be lost in rare cases. If you lose your connection you may be able to rejoin for a short time, but this is not guaranteed.

Disclaimers and limits on liability

To the fullest extent the law allows, the game is provided "as is" without warranties of any kind, and we are not liable for indirect or consequential losses, or for lost progress, items or scores, including if we shut down the game. Our total liability to you is limited to the greater of US$50 and what you paid us in the previous 12 months, to the extent the law allows. Nothing in these terms limits rights or liability that cannot legally be limited, including mandatory consumer rights where you live.

Governing law

These terms are governed by the laws of Singapore, and its courts deal with any dispute. This doesn't remove any mandatory protection you have under the laws of the country where you live.

Changes and ending

We may update these terms. We will change the date above, and give more notice in the game for significant changes. Continuing to play means you accept the new terms. You can stop playing at any time and delete your data from your Germ Journal.
